These behaviors should be uniform.

Example:

/give @s minecraft:acacia_boat[minecraft:custom_data={bar:1},] 

Result: You get the item.

/clear @s minecraft:acacia_boat[minecraft:custom_data={bar:1},] 

Result: Syntax error.
