Phantoms that spwan naturally due to players not sleeping can spawn inside solid blocks. Currently most mobs check for block colliisions in order to successfully spawn, and seems that this check is skipped for phantoms. Also sky access check is performed on the players spawning the phantoms, not the phantoms themselves.
